Terms of service

These terms cover using songbirdwebstudio.com and working with Songbird Web Studio. Your written quote has the details of your specific project. If your quote and these terms ever disagree, the quote wins.

Who I am

Songbird Web Studio is a web design studio run by Melanie Dieas, based in Florida, and operated by MBD Concept LLC, doing business as Songbird Web Studio. In these terms, "I" and "me" mean MBD Concept LLC and Songbird Web Studio, and "you" means you or the business you represent. Questions? Email hello@songbirdwebstudio.com.

Using this website

You're welcome to browse, use the pricing estimator and send me a note. Please don't misuse the site, for example by sending spam, trying to break it or copying its design and content as your own. The portfolio websites shown here belong to their owners.

Estimates and quotes

The pricing estimator on this site is a helpful starting point, not an offer. After you fill out the project questionnaire, I'll send you a written quote with a fixed price, what's included and what isn't, and a timeline. A quote is good until the date shown on it. You accept a quote by signing it, replying "approved" to it, or paying the deposit, and accepting it means you agree to these terms too. Once you accept it, that price is set for the work it describes.

Payment

Timelines

Typical timelines are 4–6 weeks for business websites and 6–8 weeks for online stores. Rush launches take about half the time and add 25% to the build price ($300 minimum; explainer videos, care plans and platform fees aren't included in that 25%). Timelines depend on getting your content, feedback and approvals on time. If those are delayed, the launch date moves too.

Your content

You're responsible for the text, photos, logos, product details and other materials you give me. You confirm you have the right to use them. You're also responsible for the accuracy of what your website says about your business, and for any policies your business needs on its own site.

Revisions

Every project includes 2 rounds of revisions. A round is one set of feedback, sent together, that I then work through, so it helps to gather everyone's notes into one message. This applies to website designs and explainer videos alike. More rounds, or changes that go beyond what your quote describes, are quoted separately or billed at $125 per hour, and I'll always check with you first.

Changes to the plan

Requests beyond what your quote covers, such as new pages or features, are quoted separately or billed at $125 per hour. I'll always check with you before doing extra work that costs more.

Who owns what

Once your final payment is made, the website I design for you and the content you provided are yours. Some parts come from other companies, such as Shopify themes, fonts, plugins and stock photos, and those stay under their own licenses. I may show your project in my portfolio and on social media. If you'd rather I didn't, just tell me.

Footer credit. Your website includes a small "Website by Songbird Web Studio" credit in its footer that links to songbirdwebstudio.com. If you'd like it removed, just ask.

Care plans and edits after launch

Care plans are monthly, billed in advance and charged automatically each month to the card or bank account you keep on file with Stripe, only available for websites I build, and include hosting for business sites (online stores are hosted by Shopify, and your Shopify plan is billed to you directly). Without a care plan, I'll move your site to a hosting account in your name, and any hosting fees (often free for small sites) are billed to you directly. You can switch plans or cancel any time from your care plan portal (the link is in your receipt emails) or by emailing me. When you cancel, your plan stays active until the end of the month you've already paid for, and you won't be billed again. Without a care plan, edits after launch are billed at $125 per hour. If your business website includes the editor, you can also make your own edits.

Other services

Your website relies on services like hosting, domain registrars, Shopify and email providers. I'll choose reliable ones and help when something goes wrong, but I'm not responsible for their outages, price changes or policies.

No promised results

My goal is a website you're proud to share. I build every site to be fast, mobile-ready and ready for search engines, but I can't promise specific rankings, traffic, leads or sales.

Limits of liability

To the extent the law allows, my total responsibility for any claim related to a project is limited to the amount you paid me for that project. I'm not responsible for indirect losses, such as lost profits or lost data. Please keep your own copies of important content.

Ending a project

Either of us can end a project in writing. If that happens, the deposit isn't refunded, any work done beyond what it covers is billed at $125 per hour, and I'll hand over what's been completed once it's paid for.

Florida law

These terms are governed by the laws of the State of Florida. If we ever disagree, let's talk it through by email first. I'm confident we can sort it out.

Changes to these terms

I may update these terms from time to time. The version in place when you accept your quote applies to your project.
